Terms of Service
Last updated: 2026-09-16 · Effective: 2026-09-16
These Terms of Service (the “Terms”) govern access to and use of the Zolie AI phone receptionist, the getzolie.com website, the client dashboard, and all related software, texting, outreach, and support services (together, the “Service”) provided by Cookie And Us LLC, doing business as Set And Forget (“Zolie,” “we,” “us,” or “our”).
This page has two parts. Part A applies to the businesses that subscribe to Zolie (“Customer,” “you,” or “your”). Part B (SMS Terms & Conditions) applies to callers who receive text messages from Zolie on a business’s behalf.
Please read these Terms carefully. They include a binding arbitration clause and class-action waiver (Section 17), an automatic-renewal and automatic-charge authorization (Section 8), a disclaimer of warranties (Section 14), and a limitation of our liability (Section 15).
Part A — Terms of Service for Businesses
1. Binding Agreement and Acceptance
By creating an account, starting a trial, subscribing to a plan, forwarding a phone line to a number we provide, connecting a booking platform, or otherwise using the Service, you accept these Terms and agree to be bound by them each time you use the Service. If you are accepting on behalf of a business, you represent that you are authorized to bind that business, and “you” refers to that business. If you do not agree, do not use the Service.
These Terms, together with our Privacy Policy, the plan and pricing you select at checkout, and any written order form or addendum signed by both parties, form the entire agreement between you and Zolie. This version supersedes all prior versions of the Terms unless we have expressly agreed otherwise in writing. The Service is offered to businesses only; it is not intended for personal, family, or household use, and you must be at least 18 years old to use it.
2. The Service
Zolie answers calls to a phone number you forward to us, speaks with callers using artificial intelligence, and, depending on your plan and configuration, books and reschedules appointments in your connected booking platform, takes messages, texts callers booking links and directions, screens spam, notifies you of calls, and sends outreach texts to your existing clients. Features vary by plan and are described at getzolie.com/pricing and in the dashboard.
We may add, modify, suspend, or discontinue any feature of the Service at any time. Features labeled beta, preview, early access, or similar are provided as-is, may be withdrawn at any time, and are excluded from any service commitment. We may also change the AI models, voices, telephony carriers, and other vendors we use to deliver the Service without notice.
3. Your Account and Your Responsibilities
You are responsible for: (a) providing accurate business information (name, hours, services, prices, policies, staff, address, and any custom rules) and keeping it current, because Zolie will repeat it to callers; (b) forwarding your line to us correctly and removing the forward when you no longer want calls answered, since we cannot control your carrier or phone system; (c) keeping your booking platform connected and authorized; (d) protecting access to your email inbox, phone number, and any sign-in links, all of which grant access to your dashboard; and (e) all activity that occurs under your account, whether or not you authorized it.
You must promptly review the bookings, messages, and notifications Zolie produces and correct any errors in your booking platform. You, not Zolie, are responsible for the appointments you accept, the services you deliver, and every interaction with your own customers.
4. Third-Party Platforms and Carriers
The Service depends on third parties we do not control, including your booking platform (for example Square, Wix, GlossGenius, Boulevard, Vagaro, Fresha, Moxie, or Setmore), telephone carriers and call-forwarding providers, SMS carriers, AI model providers, telephony and hosting vendors, and our payment processor. You authorize us to access and act in your booking platform and other connected accounts on your behalf using the connection, credentials, or public booking page you provide, and you represent that you are permitted to grant that access.
Your use of third-party platforms is governed by their own terms and fees. We are not responsible for their availability, accuracy, changes to their features or APIs, restrictions on their free tiers, or any loss caused by them, including missed or dropped calls, failed forwarding, delayed or undelivered texts, or bookings that a platform rejects, changes, or deletes. If a platform withdraws a capability we rely on, we may modify or discontinue the affected feature.
5. Artificial Intelligence and No Guarantee of Results
Zolie uses generative artificial intelligence and automated speech recognition. Like any such system, it can misunderstand a caller, mis-transcribe a name or phone number, state information incorrectly, book or reschedule the wrong service, time, staff member, or number of guests, fail to recognize a returning customer, miss a call, or behave unexpectedly. You acknowledge these limitations and agree that Zolie’s output is not a substitute for your own review.
We do not guarantee that the Service will answer every call, book any particular appointment, recover any particular amount of revenue, block all unwanted calls, or operate without interruption, error, or delay, including during carrier, platform, or internet outages. Any figures we publish about recovered bookings or revenue are examples from other businesses, not promises about yours. Nothing Zolie says to a caller is legal, medical, financial, or other professional advice.
6. Calls, Recordings, Texting, and Legal Compliance
Calls handled by Zolie may be recorded and transcribed so that the Service can work and so you can review them. You are responsible for complying with all laws that apply to your business’s use of the Service, including call-recording and consent laws (many states, including Washington and California, require all-party consent), laws that require disclosing the use of an automated or AI agent, telemarketing and text-messaging laws such as the Telephone Consumer Protection Act (TCPA), do-not-call rules, quiet-hours rules, and any consumer-protection, privacy, or industry rules that apply to your business. Zolie may play or speak an automated disclosure at the start of calls, and you agree not to ask us to remove it where the law requires it.
If you use any feature that sends texts to your own customers (including reminders, nudges, or Outreach campaigns), you represent that each recipient has given the consent required by law to receive those messages from your business, that the contact information you upload or connect was lawfully collected, and that you will honor opt-outs. We may suspend texting features, throttle volume, or require additional registration information at any time to protect our carrier relationships and comply with carrier rules, and we may refuse any message content in our sole judgment.
The Service does not support emergency calls. Zolie cannot connect callers to 911 or other emergency services, and you agree to tell your customers how to reach emergency help through other means.
The Service is not designed for protected health information (PHI) under HIPAA. Unless we have signed a Business Associate Agreement with you, you agree not to use the Service to collect, store, or transmit PHI, and you are solely responsible for any health-related information a caller volunteers.
7. Acceptable Use
You agree not to, and not to permit anyone else to:
- use the Service for any unlawful, fraudulent, deceptive, harassing, or abusive purpose, or to send spam or unsolicited messages;
- use the Service to impersonate another business or person, or to collect payment card numbers, government identifiers, or other sensitive data from callers;
- resell, sublicense, rent, or provide the Service to third parties, or use it to operate a call center or a service bureau for other businesses without our written consent;
- reverse engineer, extract, or copy our prompts, models, voices, workflows, or software, or use the Service to build or train a competing product;
- probe, scan, overload, or interfere with the Service, its security, or other customers’ use of it, or place automated or artificially generated calls to it;
- use the Service in a way that, in our reasonable judgment, harms Zolie, our carriers, our vendors, or our reputation.
We may investigate suspected violations and may suspend or terminate your access immediately, without refund, if we believe you have violated this Section or these Terms, or if your usage creates a legal, security, or carrier risk for us.
8. Fees, Billing, and Automatic Renewal
Plans and prices. Plan features, monthly prices, included usage, per-call overage rates, and add-on prices are listed at getzolie.com/pricing and at checkout, and those listings are part of these Terms. For example, the Starter plan includes 10 answered calls per month and then charges $2.50 per additional answered call; flat plans include the usage stated at checkout. Prices are in U.S. dollars and exclude taxes.
Automatic renewal. Subscriptions are billed in advance, monthly (or annually if you selected an annual plan), and renew automatically at the end of each billing period at the then-current rate for your plan until you cancel. Usage charges, overages, add-ons, and text packs are billed in arrears or as incurred.
Automatic payment authorization. By providing a payment method, you authorize Zolie and our payment processor (Stripe) to charge that payment method, and any updated or backup payment method you later provide, automatically for all recurring fees, usage charges, add-ons, taxes, and other amounts you incur under these Terms, without further notice or approval for each charge. You agree to keep a valid payment method on file and to update it promptly when it changes.
Taxes. You are responsible for all sales, use, excise, and similar taxes on the Service other than taxes on our net income. Where we are required to collect tax, it will be added to your invoice.
Price changes. We may change our prices or plan structure by giving you at least 30 days’ notice by email or in the dashboard. The new price applies from your next billing period after the notice period. Continuing to use the Service after the change takes effect is your acceptance of the new price; if you disagree, cancel before it takes effect. Promotional pricing, partner codes, referral credits, and other discounts are subject to their stated conditions, may be ended or modified at any time, have no cash value, and are void if obtained through misrepresentation.
Failed payments and past-due amounts. If a charge fails, we may retry it and may suspend the Service (including stopping the answering of your calls) until payment is received. Failing to keep a valid payment method does not relieve you of amounts owed. Amounts more than 30 days past due may accrue interest at the lesser of 1.5% per month or the maximum rate permitted by law, and you agree to pay our reasonable costs of collection, including collection-agency fees, court costs, and attorneys’ fees. We may report delinquent business accounts to commercial credit agencies to the extent permitted by law.
Billing disputes. You must tell us in writing of any billing dispute within 60 days of the charge, or the charge is deemed accepted. We will work with you in good faith to resolve legitimate disputes.
9. Free Trial, Money-Back Guarantee, and Refunds
Trial. Where offered, a free trial lasts 14 days from sign-up. Unless you cancel before the trial ends, your subscription begins automatically at the end of the trial and your payment method will be charged for the plan you selected. Trials are limited to one per business, may be subject to usage limits, and may be shortened or withdrawn if we detect abuse.
Money-back guarantee. If you are not satisfied, you may request a full refund of your first paid month by emailing [email protected] within 30 days of the first subscription charge. The guarantee applies once per business, covers only the first month’s subscription fee (not usage charges, add-ons, or text packs), and does not apply to accounts terminated for a violation of these Terms.
Otherwise no refunds. Except for the guarantee above or as required by law, all fees are non-refundable and non-creditable, including for partial billing periods, unused calls or texts, downgrades, or periods during which you did not forward your line to the Service.
10. Term, Cancellation, and Termination
Term. Monthly plans run month to month and annual plans run for the annual period you selected; both renew automatically as described in Section 8.
Cancellation by you. You may cancel at any time from the billing section of your dashboard or by emailing [email protected] from the email address on your account. Cancellation takes effect at the end of the current billing period; you keep access until then and are not charged again. Requests to cancel must be made before the renewal date to avoid the next charge. Removing your call forward, ceasing to use the Service, or disputing a charge with your bank does not cancel your subscription.
Suspension and termination by us. We may suspend or terminate your account, with or without notice, if you breach these Terms, fail to pay, create a legal, security, or carrier risk, or if we discontinue the Service or your plan. Where practical we will give you notice and an opportunity to cure. We may also terminate for convenience with at least 30 days’ notice, in which case we will refund any prepaid fees for the period after termination.
Effect of termination. When your subscription ends, we will stop answering your calls and may release the phone number we provisioned for you. You are responsible for removing the call forward from your line; calls that continue to be forwarded to a released number may fail or reach a different party. We will delete or de-identify your data as described in our Privacy Policy. Sections 5, 7, 8 (as to amounts owed), 11 through 19, and any other provisions that by their nature should survive, survive termination.
11. Intellectual Property, Your Content, and Feedback
The Service, including its software, prompts, voices, designs, text, graphics, documentation, and all improvements, and all related intellectual-property rights, are owned by Zolie or our licensors and are protected by United States and foreign copyright, trademark, trade-secret, and other laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own business during your subscription. We reserve all rights not expressly granted. You may not remove or alter any proprietary notice.
You retain ownership of the business information, custom rules, contact lists, and other content you provide (“Customer Content”). You grant us a worldwide, royalty-free license to host, copy, process, transmit, and display Customer Content, and to use call recordings and transcripts, as needed to provide, secure, support, and improve the Service. You represent that you have all rights needed to grant this license and that Customer Content does not violate any law or third-party right.
We may use aggregated or de-identified data derived from use of the Service for any purpose, including improving our models and publishing statistics, provided it does not identify you or any caller. If you send us ideas, suggestions, or feedback, we may use them without restriction or compensation. We may identify you as a customer by name and logo unless you tell us not to; we will not publish a case study that identifies your business without your permission.
12. Privacy and Caller Data
Our Privacy Policy describes how we collect, use, and protect personal information and is incorporated into these Terms. As between you and Zolie, you are responsible for the personal information of your callers and customers that we process on your behalf, including giving them any notices and obtaining any consents the law requires. We process that information to provide the Service, as described in the Privacy Policy, and as you direct through your configuration. Because callers can be reached only through the phone numbers and email addresses they provide, we cannot verify a caller’s identity, and you release us from claims arising from a caller’s misrepresentation.
13. Confidentiality
Each party will use the other’s non-public business, technical, or financial information only to perform under these Terms, will protect it with reasonable care, and will not disclose it except to employees, contractors, and vendors who need it and are bound by similar obligations, or as required by law. This does not restrict information that is public, already known, independently developed, or received from a third party without breach.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Service and all content, output, bookings, messages, and information produced by it are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. Zolie disclaims all implied warranties, including the warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. Zolie does not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, that every call will be answered or every booking completed, that AI output will be accurate or complete, that spam will be blocked, or that the Service will meet your requirements or produce any particular business result. If your use of the Service results in the need to service or replace equipment or data or any other cost, Zolie is not responsible for that cost. No advice or information, whether oral or written, obtained from Zolie creates any warranty not expressly stated in these Terms.
15. Limitation of Liability
To the fullest extent permitted by law, in no event will Zolie or its members, managers, officers, employees, contractors, agents, affiliates, licensors, or vendors be liable to you or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, bookings, customers, goodwill, data, or business opportunity, or for the cost of substitute services, arising out of or relating to these Terms or the Service, whether based on contract, tort (including negligence), strict liability, warranty, or any other legal theory, even if Zolie has been advised of the possibility of such damages.
To the fullest extent permitted by law, Zolie’s total cumulative liability arising out of or relating to these Terms or the Service, regardless of the cause of action, will not exceed the greater of (a) the fees you paid to Zolie for the Service in the three (3) months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). The parties agree that these limitations are an essential basis of the bargain, apply even if a remedy fails of its essential purpose, and apply in the aggregate to all claims. Some jurisdictions do not allow certain limitations, in which case these limits apply to the maximum extent permitted.
16. Indemnification
You agree to defend, indemnify, and hold harmless Zolie and its members, managers, officers, employees, contractors, agents, and affiliates from and against any third-party claim, demand, action, or proceeding, and all resulting losses, damages, liabilities, fines, penalties, costs, and expenses (including reasonable attorneys’ and accounting fees), arising out of or relating to: (a) your use of the Service or the services you provide to your customers; (b) Customer Content or the information Zolie gives callers at your direction; (c) your breach of these Terms or of any law, including call-recording, AI-disclosure, telemarketing, texting, privacy, or consumer-protection laws; (d) any dispute between you and a caller, customer, employee, or booking platform; or (e) your negligence or willful misconduct. We will give you prompt notice of any such claim and may participate in the defense with counsel of our choosing at your expense. You may not settle any claim in a way that admits fault on our behalf or imposes obligations on us without our written consent.
17. Governing Law and Dispute Resolution
Governing law. These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Informal resolution first. Before starting any formal proceeding, you agree to email [email protected] with a description of the dispute and to work with us in good faith for at least 30 days to resolve it.
Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including their formation, breach, termination, enforcement, interpretation, or validity, and including whether a dispute is subject to arbitration, will be resolved exclusively by final and binding arbitration before a single arbitrator administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration will take place in Seattle, Washington, or by video conference if the parties agree or the arbitrator so orders. Judgment on the award may be entered in any court of competent jurisdiction. The arbitrator may award the prevailing party its costs of arbitration, including arbitrator fees and reasonable attorneys’ fees.
Class-action and jury waiver. You and Zolie agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding, and the arbitrator may not consolidate claims of more than one party. To the fullest extent permitted by law, each party waives any right to a jury trial.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies. Notwithstanding the agreement to arbitrate, the following matters may be brought in the state or federal courts sitting in King County, Washington: (i) actions by Zolie for injunctive or other equitable relief to protect its intellectual property, confidential information, or the security of the Service, and (ii) actions by Zolie to collect unpaid amounts owed under these Terms. Each party submits to the exclusive jurisdiction and venue of those courts for such matters and waives any objection based on jurisdiction, venue, or inconvenient forum. You agree not to pursue any claim relating to these Terms in any forum outside the State of Washington and, if you do, stipulate to its transfer to Washington.
Opt-out. You may opt out of this arbitration agreement by emailing [email protected] with your business name and the statement “I opt out of arbitration” within 30 days of first accepting these Terms. Opting out does not affect any other provision.
Equitable relief and fees. You acknowledge that a breach of Sections 7, 11, or 13 may cause irreparable harm for which money damages are inadequate, and that Zolie is entitled to seek injunctive relief in addition to any other remedy. In any action or proceeding to enforce these Terms, the prevailing party is entitled to recover its costs and reasonable attorneys’ fees.
18. Changes to These Terms
We may revise these Terms at any time by posting the updated version at getzolie.com/terms and updating the “Last updated” date. For material changes we will also notify you by email to the address on your account or in the dashboard at least 14 days before they take effect, except that changes required by law or that address a new feature may take effect immediately. Your continued use of the Service after the effective date is your acceptance of the revised Terms. If you do not agree, cancel before the effective date. No verbal statement or individual email from our staff modifies these Terms; any amendment to pricing or terms for your account must be in a writing signed or expressly confirmed by Zolie.
19. General
Entire agreement and precedence. These Terms, the Privacy Policy, and your plan selection are the entire agreement between you and Zolie regarding the Service and supersede all prior or contemporaneous understandings. If there is a conflict between documents, the order of precedence is: (i) a written order form or addendum signed by both parties, but only for the specific terms it expressly changes; (ii) these Terms; (iii) the Privacy Policy; and (iv) any other document, including any purchase order, vendor form, or terms you send us, which are rejected and have no effect.
Assignment. You may not assign or transfer these Terms or your account without our prior written consent, and any attempt to do so is void. We may assign these Terms to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets.
Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control, including carrier or platform outages, internet failures, power loss, acts of government, labor disputes, pandemics, natural disasters, or failures of third-party AI, telephony, or hosting providers.
Notices. We may give you notice by email to the address on your account, by text to your account phone number, or through the dashboard. Notices to Zolie must be sent to [email protected] or by mail to Cookie And Us LLC, doing business as Set And Forget, 14101 129th Ave NE, Kirkland, WA 98034.
Severability, waiver, and interpretation. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it or of any later breach. Headings are for convenience only. “Including” means “including without limitation.” The parties are independent contractors, and these Terms create no partnership, agency, or employment relationship and no third-party beneficiaries. Use of the Service is not authorized in any jurisdiction that does not give effect to all provisions of these Terms, including Sections 14, 15, and 17.

Part B — SMS Terms & Conditions
By consenting to receive text messages from Cookie And Us LLC doing business as Set And Forget, you agree to the following terms.
Program Description
Set And Forget sends transactional SMS/MMS messages on behalf of our small-business clients to callers who interact with our AI phone receptionist. Messages include booking links and directions to the business that callers request during a phone call. Appointment confirmations and reminders are handled separately through each business’s own scheduling system (such as Square or Wix) and are not part of this SMS program.
Opt-In
You may opt in to receive text messages by verbally requesting a text during a phone call with one of our AI receptionists.
You are not required to opt in to SMS as a condition of purchasing any service.
How the Verbal Opt-In Works (Detailed)
Set And Forget operates AI phone receptionists for small-business clients. SMS consent is collected exclusively during live, inbound phone calls — never via web form, web checkbox, keyword opt-in, or third-party list. The flow:
- You dial the business’s published phone number and reach the Set And Forget AI receptionist.
- You verbally request booking help or directions during the conversation.
- The receptionist asks you verbatim: “Can I text you a booking link at this number?” — or, for directions: “Want me to text the address?”
- The receptionist proceeds only if you give explicit verbal confirmation (“yes”, “sure”, “please do”, etc.). Ambiguous or negative responses cancel the SMS path.
- Each consent event is logged in our database with your phone number in E.164 format, an ISO 8601 timestamp, and the Vapi call SID for that call. Consent logs are retained for 12 months.
Sample Call Transcript
The following is a verbatim transcript excerpt from a representative call demonstrating steps 3–4 above:
Receptionist: “Great, I can help you book a facial. Can I text you a booking link at this number?”
Caller: “Yes please.”
Receptionist: “Sending it now. You should see the text in a few seconds.”
Message Frequency
Message frequency varies based on your interactions. Typical volume is 1-2 messages per phone call.
Message and Data Rates
Message and data rates may apply depending on your mobile carrier and plan. Set And Forget is not responsible for any charges from your carrier.
Opt-Out
You can opt out at any time by replying STOP to any text message you receive from us. You will receive a one-time confirmation that you have been unsubscribed. After opting out, you will no longer receive text messages from us unless you opt in again.
